Mediation Program

This is the Mediation training course you've been waiting for! It's based primarily on the lessons we've learnt through almost 20 years of "real" mediation experience with hundreds of private and voluntary, rather than compelled and institutional, mediations; extensive research; process experimentation, and a similar period of both giving and receiving formal and informal training.

The program comprises 4 separate, interlocking modules. It is offered as a series of progressive courses (with the mediation component lasting 2 days), or it can be undertaken as a single, continuous program, over 5 days.

We teach this course/program with due regard to what we believe is the true purpose, function and intention of mediation - the development of creative and strategic solutions for complex problems in situations where parties have strongly competing or conflicting needs, interests and positions.

Our focus in this course is on teaching students how to apply their foundation skills in problem solving, decision making, communication and negotiation, in the highly structured and, at the same time, almost infinitely flexible environment of mediation - so they can help others achieve the outcomes they want and need.

Training to this level (+ appropriate assessment) satisfies most current Australian standards for professional mediator training. It allows you to hang up your shingle to tell the world you're a mediator - although we strongly recommend adopting a "trainer-wheel" approach, which requires you to co-mediate, or undergo supervised mediation, until you have sufficient experience to confidently go it alone.

We also believe that this 5 day course is one of the most effective advanced leadership and management training programs available anywhere in the world. Participants with the intrinsic character, experience and skills to fully capitalise on what we teach in this program gain both the knowledge and the skills to become enormously more effective in their inter-personal and wider group persuasion and influence.

For leaders - we address the need for practical, "human connection" skills to help them convert their charismatic vision and high voltage drive into serious implementation plans and real commitments that can actually be grasped and made to work by others (ie: their loyal followers).

For managers - we address the need to develop the high level competencies in persuasion and influencing required to make the most of modern collaborative approaches to enhancing team performance. In line with our observations on process-oriented mediation training below, we often hear of management courses that suggest the holy grail of optimal team performance can be achieved through the application of best practice process, without ensuring that the managers responsible for introducing and operating the process properly actually have the relevant skills required to manage the process effectively.

There are a number of admirable mediation training programs currently being taught around Australia. They are mainly taught by academic or practising lawyers and they tend to be highly process-oriented - using negotiation and conferencing techniques to bargain or compromise a path to mutually acceptable outcomes. They also usually focus on legal-type claim scenarios.

In what is a deliberately conscious contrast, our training has a different focus, and is designed to produce different outcomes. As Solutionists, we believe that whenever possible (because it isn't, always), and to the greatest extent possible, mediation should be a facilitated, creative and strategic process that is squarely focussed on problem solving the actual issues and the relationship issues between competing and/or conflicting parties. This means that when properly executed, the solution will be expansive - addressing all aspects of the problem (financial, physical, personal and inter-personal).

We think this is preferable to the alternative - producing introspective solutions - ones that are more likely to be restricted to addressing the presenting, surface level issues, perhaps on a compromising (down to a lowest acceptable common denominator) basis - often just a monetary settlement.

Learning Objectives

As with all TSG training, this course is customised to address the individual circumstances and needs of individual participants, and of specific businesses, organisations, professions and industries.

The primary objective of this course, or program, whether participants just do the final (2 day) mediation module, or undertake the complete 5 day program, is to equip them to act as a mediator, either in their own workplace and life activities, in a professional capacity as a mediator, or as an adviser involved in mediation processes (eg: lawyer representatives).

Hierarchy of Skills - Position in Skills Development Program

This is a Level (4) course that builds on the knowledge and skills acquired in earlier foundation skills courses covering: (1) Problem Solving & Decision Making; (2) Communication and Balance Communication and (3) Negotiation.

Alternatively, participants may have obtained significant knowledge from other (there are no comparable!) courses and relevant skills from practical experience. It is important that the appropriate knowledge and skills base be present, otherwise participants may find themselves at a loss to span the gap between the processes they have been taught in other programs and the skills they will be expected to have if they've been through our foundation training courses.

Accreditation and Recognition as a Mediator

Our course is approved by IAMA (Institute of Arbitrators & Mediators Australia) as delivering all of the mediation training content required by current Australian standards.  It has similar standing to IAMA’s own mediation training – after completing the program, participants seeking accreditation as mediators need to join IAMA and undertake an interview.  Provided they are successful, they may be included on IAMA’s Register of Mediators.
