Nature of Expert Assessment
Expert Assessment is part Dispute Facilitation and part Expert Determination.
In the TSG context, the concept is unique, being quite different to the relatively conventional service that bears the same name and is offered by Dispute Solutions. TSG's Expert Assessment is an independent, professional, expert review and assessment of both the actual issues in dispute (commercial / financial / personal etc) and the conflict management / dispute resolution process being used to deal with them.
We prefer to be jointly commissioned by all parties, this helps the TSG Expert Assessment process to focus on strategic, rather than on detailed factual, issues.
Having performed our review(s), we provide written and verbal observations and recommendations for the efficient future conduct of the rest of the dispute resolution process. If required to do so by all parties, we will happily take over the running of the dispute resolution process.
Expert Assessment is typically used when parties (and/or their advisers) are unsure of how best to proceed, or when one or more parties lack confidence that the dispute is being resolved as well as they would wish - perhaps as a result of time, cost, delay, comprehensibility, suitability to needs etc.
