Dispute Resolution & Conflict Management

Overview

Conflict management and dispute resolution are, primarily, the work of our genetic imprint / DNA donor / parent: Dispute Solutions. Indeed, the very concept of Solutionism was developed by Dispute Solutions as a response to the sub-optimal and inefficient ways most disputes and conflicts are nurtured before being resolved through our traditional adversarial mechanisms (argument, threats and, ultimately, litigation).

It was deeply frustrating - seeing otherwise intelligent and sensible people allowing themselves, and frequently throwing themselves (mainly using shareholders' money), into these fighting processes that, to any outsider, were clearly nothing more than ego-driven power plays that became intellectualised (sometimes) and ritualised (automatically) as set piece battles, once they got into the legal system.

Once there, the problems themselves, and the people behind them, rapidly shrank into insignificance as the champions (lawyers) stepped forward bravely to joust on their clients' behalves. Extraordinary really how many of these battles were ultimately settled on the steps of the courtroom, just before the actual merits and quality of the work done had to be put to the test. But of course, by then most of the fees had been earned (often exceeding the amounts in dispute) and at least by avoiding any real battles the lawyers didn't get hurt and there were lower maintenance charges on the champions' armour!

Through involvement with many hundreds of conflicts, both large and small, Dispute Solutions discovered a serious, and consistent, "disconnect" between what was wrong, what most people really wanted to do about it, and what they ultimately got, either through their own inertia, their ineptitude (inability to problem solving and negotiate directly), or through litigation.

In the 1980s, Mediation was introduced to Australia. It seemed to offer the promise of placing more focus on and acceptance of the creative problem solving side of resolving a large number of disputes and conflicts. Dispute Solutions, at least in its preceding incarnation, travelled joyfully and expectantly down this path and, to this day, practises a heavily solution-oriented approach to most of the disputes and conflicts it deals with.

In the area of conflict management the main difference between TSG and Dispute Solutions is that the latter deals with disputes and conflicts as a dispute resolution specialist that applies the principles of Solutionism as much as possible in any given circumstance.

In contrast, TSG specialises in problem solving , first and foremost. If a problem happens to have arisen within a conflicted environment this simply adds another dimension to the problem solving exercise which, of course, we are uniquely well qualified to handle.

Using many of the same people and resources, TSG operates within a more tightly focussed conflict management arena - working mainly with interpersonal conflicts that have long term ramifications such as: family business and family disputes generally, partnership and workplace disputes.
